Acting NABPTEX Boss Writes To New Crusading Guide -Demanding Apology

The Acting Executive Secretary of the National Board for Professional and Technician Examination (NABTEX) is demanding an apology for a defamatory story published against her.

A letter signed by her lawyers, Akufo Addo Prempeh &Co signed by Frederic Boamah Esq, says that “In about March 2017n the president of the Republic of Ghana appointed our client as the Acting Executive Secretary of NABPTEX. Upon the said appointment of our client as the acting executive secretary of NABPTEX, you have subsequently petitioned the president of the Republic of Ghana, Challenging her qualification as well as her competency for the position and urged the president to revoke her appointment”.

 “In the said petition sent to the president, which you caused to be published in The New Crusading Guide on Wednesday 4th October 2017, on your Front Page and under the banner headline “FORMER NABTEX BOSS DRAWS DAGGER …. Lampoons Sheila Boamah, Petitions president”. In the said publication you are quoted as saying the following: “However, of late, NABTEX’s name has been in the news for the wrong reasons and the morale of the staff has gone down, all because of the appointment of the Acting Executive Secretary. I believe His Excellency will like his administration to be very successful and would therefore not give positions to incompetent and unqualified persons”.

“Under normal circumstances, she wouldn’t even qualify to be shortlisted for an interview to any position in an examination body, let alone becoming the head of the organization. Contrary to your statement (above) our client meets and satisfies all requirements imposed by law which make one eligible for appointment as executive secretary of NABTEX. These requirements are found in the National Board for Professional and Technician Examination Act.1994 (492) and the 1992 constitution of the Republic of Ghana”.

“Our client is therefore competent and qualified for the position of Executive Secretary of NABTEX and there was no reasonable basis for challenging her competency in the petition published in the New Crusading Guide”.

“In addition to challenging our client’s qualifications and credentials you have also cast very serious aspersions and made very disparaging statements about our client as follows”.

“ when in 2002 NABTEX decided  to introduce its Grading system and Polytechnic students went on strike for several weeks and the then minister of education , Prof Ameyaw Akumfi , set up a committee that came out with a grading system that allowed a student to obtain First Class without scoring a single “A” in any  of the courses, it was I , the then executive secretary at the time , who pointed it out to the board and came out with a solution  which is the HND Grading  system  still in use. Should a similar situation arise, how can the Acting Executive Secretary identify the problem, let alone, finding a solution to it.?  If she were to attend any international conference, as the head of NABPTEX, what will e her contribution and what impression will the international community have on our qualifications?”

Consequently, upon this facts , we have advised our client in respect of her legal  rights and remedies at law ; whereupon our client further instructs us to draw you attention to the following

You have the right as a citizen of Ghana to petition any authority, including the president of the Republic, on any matter that is of concern to you.. While you have the above right, you do not have any right, whatsoever to publish any defamatory matter about our client whether through a petition or otherwise.

Besides, presenting to the president of the republic of Ghana a petition containing defamatory statement against our client, you’ve further caused this defamatory statement to be published in the New Crusading Guide newspaper. These statements have further found their way into other media, including electronic media such as the World Wide Web and have caused grave damage to the image of our client who enjoyed an unblemished record before your willful act of defamation.

Our client served as the chief executive officer of the Student Loan Trust Fund prior to her appointment as Acting Executive Secretary. Our client chalked many successes during her time at the SLTF including establishing a scheme of service, which scheme continuous to run till this day, an unprecedented feat. Our client has been acknowledged for her sterling leadership by the National Union of Ghana Students (NUGS), another feat never previously attained by an institutional head of a body which interfaces with students independently of a university. In addition to this, our client has also received recognition and awards from diverse student bodies across the country and was listed and awarded as one of the top women cooperate leaders in Ghana”.


“Consequently, our client firmly instructs us to demand from you and we hereby demand from you jointly and severally the following”.

“A. an unreserved public apology to our client for the damage caused to her reputation by your publication of the said petition. Payment of the sum of Five Hundred Thousand Ghana Cedis (GHC500, 000.00) as compensation for damage to the reputation of our client without further recourse to you”.


NB. The New Crusading Guide wishes to apologize to Mrs. Sheila Naa Boamah for the damaged caused her with regard to this publication.
