Chief of Staff of the Nungua Stool in Accra, Frank Kofi Lewi, has responded swiftly to Greater Accra Minister, Henry Quartey’s revelation that due to new intelligence of a potential clash over a long-litigated land, parts of East Legon have been declared a security zone.
According to the chief of staff, the minister’s declaration was contemptuous and an affront to the Supreme Court Judgement which declared Top Kings; with the Nungua Stool as the grantors, as the owners of the large track of land lying and situate at East Legon, in Accra.
“In any case, why is the minister not asking REGSEC to ensure that the one who won the judgment is protected but rather interested in declaring the area a security zone against the Supreme Court Judgment. Is he inferring that the Supreme Court Judges who gave the judgement didn’t know what they were doing? The laws of this country have to be respected and our 14-member legal team would meet on this to determine the next line of action,” furious Frank Lewi stated.
On what authority, Frank Lewi challenged, is the minister declaring the place a security zone? There is no tension in the area. It’s some miscreants who are refusing to obey a Supreme Court order. The President urged us to be citizens and not spectators, so let everybody who must hear know, that nobody can intimidate us on our own land, it would be the last thing. The intimidation and arbitrary arrest must cease. Somebody should tell our leaders that they are over protecting foreigners against their own,” he added.
Mr. Lewis urged political leaders to respect the laws of the country, especially a Judgment from the Supreme Court, interspersing his caution with questions as “where were those declaring the area a security zone now when the parties were battling it out in court the past twenty years and over?”
It may tarry but no one would be spared when the time comes for the Nungua Stool to cite some people for contempt, Frank Lewi stated saying that, “As long as I remain the Chief of Staff of the Nungua Stool, the residents would atone tenancy to the Nungua Stool, so everybody should be aware, that when the time comes I will use every legitimate means to ensure justice is served to the Stool and I will protect every property of the Nungua Stool Lands.”
Recall that on June 24, 1999, Empire Builders took Top Kings Enterprise Limited (Top Kings) to court for trespassing on a 62-acre Empire had Title to.
In its judgment of the June 11, 2003 the High Court, Coram: His Lordship Justice Brobbey JSC (as he then was) sitting as additional High Court Judge, held that Top Kings’ was to, and I quote, “keep the portion of the disputed land that are already in its possession.”
Back and forth, the case travelled through to the Supreme Court and Top Kings Enterprise Limited still won judgement.
It is at a time when the company is making efforts to enforce the Supreme Court Judgement that the Greater Accra minister, Henry Quartey declared that area a security zone.
