The Proprietor of Erata Hotel and the Managing Director of Erata Motors, Mr. Eddie KusiAnkomah, has been jailed for contempt of court by an Accra High Court (General Jurisdiction 2).
In September 2020, he used land guards to break into a fenced land under lock and key. The land in dispute is located at shaishie near bush canteen in east legon. Eddie KusiAnkomah’s land guards were arrested by policemen from the Anti-land guard unit of the police headquarters, the ERATA boss then brought a bailiff to the police headquarters to serve an interlocutory injunction on the owner of the said land.
The land owner who allegedly got his land in 2003 was served with the said interlocutory injunction. The ERATA boss then moved straight to the site with his land guards and an earthmoving machine, pushed the tipper truck and the container on the land(belonging to the land owner) and started construction work. He worked day and night under the supervision of his land guards. Attempts by the lawyers of the landowner to draw his attention to the illegality fell on deaf ears as he kept on building.
By the time the motion for interlocutory injunction was moved he had finished with the ground floor, the first floor and was on the second floor. On the 24th of November, 2020, when the motion was moved, an order was made by the judge of the trial court restraining both parties not to do any work on the land however, Eddie KusiAnkomah did not heed the order of the court. His workmen went to the site on the 25th, 27th and 28th of November, 2020 and worked; and whiles they were working the landowner took pictures of them and brought contempt charges against him.
After hearing from the counsels of both parties, the judge of the General Jurisdiction 2 Court His Lordship Eric Baah concluded that, Mr. Eddie KusiAnkomah willfully disregarded and disrespected the order of the court and sentenced him accordingly.
- Sentenced to one day jail term
- Fined Gh¢10,000.00 (Ten thousand Ghana Cedis) and default go to jail for three months
- Cost of Gh¢20,000.00 to be paid to applicant.
