This paper has established that Management of Amocad Limited has used landguards to forcefully eject some property owners in New Kitase from their lands.
The action according to checks, was conducted without any Police or Court Order, when apparently, there is a pending Interlocutory Injunction on the said land.
It would be recalled that City Spaces, Construction and Property Brokering Company was fronting the illegal sale of parcels of land belonging to members of the Association of New Kitase Land Owners.
However, that gave Amocad Limited the opportunity to encroach and take over the said lands with the support landguards.
The development resulted in a Legal Battle where an Interlocutory Injunction was placed on the land until the final determination of the case in Court.
However, Amocad Limited continues to disobey the Court orders by employing landguards who stormed the land and eject residents amid threats of killing them if they resist their actions.
The Private land owners have been living in constant fear as they are to contend with the actions of the armed landguards who have entered the community all in the name of securing the land for Amocad Limited.
Speaking to aggrieved residents, they noted that although there is an Interlocutory Injunction on the land, Amocad Limited together with its workmen, assigns, and landguards, have brought the landguards to eject them from the land claiming ownership over it in blatant disrespect to the Court Order.
An Order for Interlocutory Injunction was granted in Suit No. C1/19/2021, where Plaintiffs; Obaahemaa Nana KorkorNtim II and Nana AduAmpoma II, dragged Francis KoteiAfutu, Isaac DodziMordo, MrZumah, City Spaces Property Brokers and Amocad Limited (Defendants) to Court.
The Plaintiffs, in their Affidavit filed on March 3, 2021, prayed the Court for an order restraining the four defendants acting in themselves, their agents, workmen, Assigns and landguards from entering the land. The Court presided over by Justice Mariam Sinare on May 10, 2021, ruled that the land in dispute between NiiAfutuBrempong III (Defendant) and NiiArmah Kwarteng on the one hand and Obaahemaa Nana KorkorNtim II, AbusuapanyinBarima Kofi SakyiKyidomheneKwakuAgyemang (Representing Asona Family of KitaseAkuapem) on the other hand, is valid and legally binding and that its terms must be specifically performed.
Information gathered is that, Amocad Limited is insisting on taking over the land so it could give City Spaces to continue selling the ‘stolen’ lands.
Affected residents and land owners are appealing to the IGP and the Minister for Lands to intervene since the Action by Amocad Limited is in strict contravention of the rules of Court and a mockery on our judicial system.
