The two accused persons, Simon Anthony Saoud and his son Kelvin Saoud were facing charges of causing harm contrary to Section 69 of the Criminal Offenses Act 1960 (ACT 29) after they discharged a Beretta pistol with serial number H77123Z without authority with the intent of causing harm to the complainant, Charles Otoo.
Facts of the case available to this paper indicate that, on December 26, 2021 around 8:30pm the Okpoi-Gono District Command received information that a group of people had engaged in a fight at Alternative Apartment6 located on the Spintex Road behind Robinhood Hotel.
Upon receipt of the said information, the police stormed the area and established from investigations that, the Complainant Charles Otoo visited his Russian Girlfriend at the Alternative Apartment and after spending some time with the girlfriend in town, decided to return to the girlfriend’s apartment at the 4th floor of the said Apartment but they had difficulty opening the door to her apartment.
This led to an argument between the two.
Meanwhile, a neighbor, Serge Osta approached them to offer help and in the process a misunderstanding ensued between Serge Osta and the Complainant resulting into a fight.
According to the police, the first accused, Kelvin Saoud and his father Simon Anthony Saoud who were the owners of the apartment heard of the noise and rushed to the scene to find out what was happening.
Whilst going to the scene, Simon Anthony Saoud armed himself with a Beretta pistol.
The controversies escalated when Simon Anthony Saoud and Kelvin Saoud joined to separate the fight.
“Simon Anthony Saoud managed to call Kennedy Atongo who is a security man for the apartment to the scene. However, A2 ordered Kennedy Atongo to move the complainant who was suspected to be heavily drunk to the vehicle. They all moved to the ground floor and the complainant was ordered to move out of the premises,” the police stated.
It was also indicated that whilst the complainant was being escorted out of the premises, he threatened to bring out a gun which he was keeping in his car and upon hearing that, Simon Anthony Saoud who was already armed gave a warning shot to the air to stop the complainant.
However, his action infuriated the complainant, Charles Otoo who then approached Simon Saoud amid a struggle and in the process, the gun went off hitting the complainant on the right foot.
He was rushed to the Inkoom Hospital for medical attention.
Meanwhile, a search conducted in the Complainant vehicle revealed a pump-action gun GX812 with serial number 18A8407 with 8 rounds of ammunition. These were retrieved by the police.
Upon investigations, the police arrested Simon Anthony Saoud and his son Kelvin Saoud and charged them for court.
