EDDT Flouts Court Order …On Tse Addo Lands

Heads and Elders of the Odoitso Odoi Kwao family of La have expressed their displeasure at the way and manner some persons continue to encroach the Tse Addo lands in gross disregard to a High Court Order.

According to the Heads of the Odoitso Odoi Kwao family, the family will soon take legal action against persons who have been laying claim to their land and selling them to unsuspecting buyers without due recognition to the rightful owners.

They revealed that the family, Odoitso Odoi Kwao family, in 2018 filed a Writ at the High Court for an Order for Interlocutory Injunction over the Tse Addo land which was granted by the Court.

In the said case, Suit No. LD/0688/2018, the family led by Mike Nii Odoi Laryea (Plaintiff) filed a Writ against Ben T. Quaye of Ataa Tawiah and Odoi Kwashie Families, The Trustees of the East Dadekotopon Development Trust and the Lands Commission as Defendants, for the Court to refrain them from interfering with the ownership of the Odoitso Odoi Kwao family land at Tse Addo. 

The Court however, upon reading the Affidavit of Mike Nii Odoi Laryea of La Accra against the Defendant which was filed on the June 5, 2018 in support of Motion on Notice of Interlocutory Injunction and upon hearing D. K Nyamekor Esq. Counsel for and on behalf of Plaintiff/Applicant granted the Order.

According to Justice Osei Tutu, Justice of the High Court the “Defendants/Respondents their servants , agents, privies, workmen, grantors, whomsoever or otherwise howsoever from claiming ownership over the disputed land or in any other way are restrained from interfering with the ownership of the Odoitso Odoi Kwao Family, either by granting the disputed land or any part thereof to a third party or developing or trespassing or engaging in whatsoever on or with the disputed land pending the determination of the Suit.”

Meanwhile, the Odoitso Odoi Kwao Family said it is uncomfortable with the current development on the disputed Tse Addo land.

They indicated that there are clear indications that the Defendants in the said case are still holding interest in the land and are using the police to terrorize residents and land owners on the land.

According to the family heads, some police personnel have on countless occasions, visited the said land and instead of protecting land owners are rather engaged in land guard duties for the Defendants, assisting them in demolition peoples’ properties on the land in disregard to the Court Order.

They revealed that a police officer, DSP Atuluk has been leading groups of officers to the land in question not to ensure calm, peace and tranquility, but with the interest of helping their paymasters to demolish ongoing and completed projects on site.

The Odoitso Odoi Kwao Family enumerated that those who continue to invade Tse Addo land with impunity will soon be hauled before the Courts for Contempt.
