The Gbawe Kwatei Family has urged the general public to disregard Akumajay Stool’s Claim of Having Procured Judgement against the Gbawe Kwatei Family.
The Gbawe Kwatei Family said the recent publication by the Akumajay Stool in which publication the said Stool made several spurious statements including “Court declares Akumajay Stool owners of Mallam Market, Dansoman and other areas in Accra,” is false and an attempt to throw dust into the eyes of the public.
Speaking in an exclusive interview, the Family Secretary Of Gbawe Kwatei Family–Accra, Solomon Nii Afutu Quartey made references to the ruling of the Accra High Court (Land Division 5), dated 18th July, 2023 and delivered by Her Ladyship, Justice Rita Abena Abrokwah Doku (Mrs.) in the suit “SUIT NO: LD/09/02/2018 – Nii Ayikai III vrs The Regional Lands Officer and Nii Adam Kwatei Quartey (Head of the Gbawe Kwatei Family), saying that the Honorable Court, stated through Her Ladyship, Justice Rita Abena Abrokwah Doku (Mrs.), held that “Order of Mandamus” granted by the Accra High Court (Land Division 1) on 10th August, 2016 constituted a breach of natural justice against
the Akumajay Stool as they were not adequately informed of the trial, and is accordingly set aside on same grounds.
“That the MANDAMUS ORDER was against the Regional Land Officer of Lands Commission to comply with the Justice Victor Ofore Judgment dated 11th July, 2006 Suit No SUIT NOs: L215/001 and AL//23/2003.”
He ecplained that the Akumajay Stool is hiding behind the setting aside of the Mandamus Order to claim that it had won a judgement against the the Gbawe Kwatei Family.
He said: “The Akumajay Stool HAS NOT WON ANY CASE AGAINST THE GBAWE KWATEI FAMILY in regards to any disputed land or lands. The general public is urged to completely disregard the false claims as merely a creation of a group of confused minds. For the purposes of the records, the following are some notable cases between the Gbawe Kwatei Family and the Akumajay Stool in which the Gbawe Kwatei Family’s undisputed ownership of several portions of lands being claimed by the said Stool were firmly affirmed by the Court.”
Solomon Nii Afutu Quartey also indicated that the consolidated suit cases in an Accra High Court dated 11th July, 2006 with SUIT NOs: L215/001 and AL//23/2003 by Justice Victor Ofore, In the Court of Appeal (Civil Appeal Division) dated 5th May, 2009 with SUIT NO: H1/215/2009, The Republic vrs Regional Lands Commission and Nii Ayikai III, Ex parte Nii Adam Kwatei Quartey in SUIT NO: FALM/9/13 dated 27th March, 2013 by Justice Eric Baah, Nii Ayikai Iii Vrs Nii Adam Kwatei Quartey dated 11th February, 2019 Justice Anthony Kofi Abada Suit NO.LD/1391/17 are cases the Gbawe Kwatei Family won.
“On the basis of the above, the Gbawe Kwatei Family hereby urges the general public to completely disregard the spurious claims by the said Stool and treat their publication with the contempt it deserves.”
The family further issued a strong word of caution to the general public to desist from dealing with the Akumajay Stool on any Land business along areas mentioned in their misguided publication; inclusing Mallam Market, South Odorkor, Gbawe Gonn Kpataa (Mataheko), Gbawe Kpeehe, Gbawe Okoefioman (South Odorkor), Gbawe Koenyonaa/Part of Dansoman and Gbawe Otojor.
