The Amasaman District Court has granted Naa Akushia Cudjoe and others (Plaintiffs) to recover all stool properties, stool lands and family lands situated and lying at Kwashiekuman, near Amasaman in the Greater Accra Region.
The court presided over by Her Worship Emelia K. Abroquah, in the matter of Naa Akushia and others versus Fred Guamah granted the order after the plaintiffs applied to the court to enforce the judgment of the Judicial Committee of Sempe Traditional Council.
This came about as a result of the misunderstanding between the complainants and defendants upon the demise of the late Chief of Kwashiekuman, Nii Kojo Amponsah III.
Since Kwashiekuman falls under the Sempe stool, the late Sempe Chief, Nii Adote Obour II set up a Judicial Committee in 2013 which was headed by Nii Adote Moffat to settle the matter.
It was established that the complainants had equal and unfettered claim to Kwashiekuman. Their portion of the land had been indentured between their elders and the late chief, Nii Kojo Amponsah III.
The complaints had hoped that with the settling of the matter by the Judicial Committee the (defendants) would adhere to the recommendations in other to ensure peace and harmony but this unfortunately was not the case.
The complainants thereafter commenced legal action against them (defendants) at the Amasaman District Court and won all its cases.
The court granted the application in a form of formal decree. Subsequently, writ of possession was issued. The respondent on 12 may, 2016, filed a motion to set aside the writ of possession on 8thFebruary, 2017. The Court dismissed the respondent’s application on 12th June, 2017; the court granted the plaintiffs application to renew the writ of possession.
The respondents again filed a motion on the 9th of October, 2018 to set aside the writ of possession. The Court dismissed the application and awarded costs of GHS 500.00 against the defendants on the grounds that they cannot file the same motion again and that the application is an abuse of the court processes.
Naa Akushia Cudjoe and others (Plaintiffs) has served notice that per the judgment of the court dated 25th February 2014 ordered them to recover all stool properties, stool lands and family lands.
