The Osu Stool Council has petitioned the Chief Justice to investigate and institute the necessary disciplinary action against Kwame Fosu-Gyeabour, describing his conduct as unethical and against the rules of the legal profession.
In the petition signed by Nii Okwei Nortey, Osu Stool Secretary, he indicated that Kwame Fosu-Gyeabour was the lawyer for the Osu Stool by virtue of his appointment by the Osu Paramount Chief, Nii Okwei Kinka Dowuona VI and in all the cases that he was prosecuting on behalf of the Stool, the Osu Mantse was representing the Osu Stool.
However, the petition, dated 3o October this year, pointed out that Kwame Fosu-Gyeabour continued to represent the Osu Stool in Court even after the death of Nii Okwei Kinka Dowuona VI on 5th November 2021, “as if his mandate was not terminated by the death of Nii Okwei Kinka Dowuona VI.”
The Osu Council argued that Kwame Fosu-Gyeabour ought to have known that upon the death of Nii Okwei Kinka Dowuona VI, he ceased to be the legal representative of the Osu Council.
Also, it was stated in the petition that “When the Osu Mankralo and Vice President of the Osu Traditional Council was acting as Osu Mantse, he did not take any steps to renew the mandate of Kwame Fosu-Gyeabour Esq,” and that the Osu Mankralo also died on January 12, 2022 but Kwame Fosu-Gyeabour Esq. continue to act without any mandate.
The petitioners also revealed that, currently there exist a litigation over who is the proper Osu Mantse pending at the Greater Accra Regional House of Chiefs, Dodowa of which this same Kwame Fosu-Gyeabour Esq. is representing one of the claimants to the Osu Stool at the Greater Accra Regional House of Chiefs.
Although the Greater Accra Regional House of Chiefs has not declared any of the two claimants as the proper Osu Mantse, the petitioners are of the view that the actions of Kwame Fosu-Gyeabour Esq. amounts to conflict of interest and acting unethically as he was acting for one of the claimants to the Osu Stool and at the same time, acting as lawyer of the Osu Stool in various matters before the Court.
In view of these, the Osu Stool Council has called on the General Legal Counsel to investigate the matter and render the appropriate sanctions.
