The embattled Ex-Chairman of the Christian Divine Church(CDC) Apostle Ebenezer Boahen and another Pastor from the Prestea branch of the CDC called Pastor Augustus Akyena Agyeman have been hurled before a Tarkwa circuit Court to answer charges as to why they organize meetings and make appointments without locus.
Members of the Pastoral Council of the church who are plaintiffs in this matter are seeking reliefs of the court to grant that the Defendants purportedly holding themselves out as Interim Administrative Committee of the CDC is in error and not founded in the church’s Constitution because these two pastors are officially retired.
They sort for another declaration that the court grant that the two retired pastors could never hold any administrative position in the church and that it’s only the Pastoral Council of the CDC that has the mandate to elect a new chairman in the event where the Chair becomes vacant.
And finally, a plea for perpetual injunction restraining the Defendants, their agents and assigns and any other person from holding meetings and performing transactions on behalf of the church.
The defense counsel in turn told the court that the plaintiffs lack capacity to sue per their church Constitution and that the action is frivolous.
But the plaintiffs’ counsel refuted that claim vehemently leading to adjournment by the sitting judge till 12th January 2024.
