Head of the Akwerh family of Hwakpo, George A. Akwerh who had led the family to Court over the ownership of Hwakpo lands and secured judgment in its favour, has expressed great satisfaction at the latest development.
According to him, he was excited that at last, the Court has given judgment in the family’s favour making it the allodia owners of a vast plot of land bordering the four corners at Hwakpo.
Speaking in an interview after the ruling in Court, George A. Akwerh said the journey from 2014 has not been easy and that he gives Glory to God and the entire family for standing behind him in the pursuit for justice.
He indicated that the Tema High Court entering judgment in favour of the Akwerh family is welcome news.
Represented by their Counsel, Sarah Coleman (Ms) for Modesto KpodoviaEsq., the family (Plaintiff) filed a Writ, E1/143/2014, on July 25, 2014, and on May 28, 2021.
The Plaintiffs were seeking a Declaration that all the parcel of land situated at Hwakpo Ada in the Dangme East District, in the Greater Accra Region is the property of the Akwerh family of Hwakpo.
The Plaintiffs provided documents to the Court showing all relevant boundaries to that effect.
They have also sought to recover and take possession of the said land and a perpetual injunction restraining the Defendants, Nene Jonathan T.A Addo III, chief of Addokope, Nene Addie, Samuel Asamannuyuah, JulitsehBuerKlofia, ObliteyAsamanuyah (deceased) and Madam Afimah from entering the land.
The rest of the Defendants were NyamidiuehAddi (sub. Benjamin Senor Adi), Tetteh-KpohAdi, Madam AguyoBuertey, George Asamanuyuah, BuerteyAsamanuyuah (deceased) and Foreman Addi all from Addokope.
Meanwhile, in its Judgment, the Court stated that, “However, no evidence was led to establish the fact that the defendants disposed the plaintiff family from the disputed land and then possessed it for over 12 years. The 1st, 3rd, 4th, 7th, 8th and 10th defendants’ counterclaim fails.”
The Court, presided over by Her Ladyship Mrs. Elizabeth Ankumah J., gave its judgment, giving the reliefs the plaintiff sought, granting all four reliefs the Plaintiff sought, whilst awarding cost of GHȻ25,000 against the Defendants.
