An Accra High Court(Land Division) presided over by Justice William Appiah Twumasi has ordered for the stay of execution of possession on a disputed Adjiringanor/Borteyman landed property for failure on the part of the proponents of title to the land to meet conditions precedent.
This matter was between Adjetey Agbonsu and five others versus Ebenezer Nikoi Nortey and two others as Defendants as well as Bernard Kobina Damtsi Dampson and others as interested parties in the matter.
In an earlier ruling at the High Court, it had granted the Respondents application for possession which didn’t go down well with Nii Afutu Gbomosane III so he quickly filed notice of appeal seeking to set aside the court ruling.
Right on the back of the notice of appeal, he(Nii Afutu Gbomosane III) also proceeded to file application for stay of execution and same served on the respondents through their counsel.
However, despite the service of the application for stay of execution which was slated to be heard on 31st July 2024, the respondents had been adamant and had forceful tried unconventional modus operadi to possess the land which clearly undermines the due processes of court.
Finally, at the last hearing on 31st July 2024 on the issue of stay of execution of possession of the land, the trial judge His lordship Appiah Twumasi without equivocation and without mincing words stated that having heard from the learned counsels from both parties, he was of the considered view that the application for Stay is granted because the 6th substituted Plaintiff had not met the order as set out in the Court’s ruling dated 10th July 2024.
