A Winneba District Court last Friday threw out the Parliamentary Candidate of the National Democratic Congress (NDC), James Kofi Annan, over an application he filed to excuse himself from complying with the Orders of the Court.
The Court, presided over by His Worship Isaac Oheneba Kufuor, on August 28, 2020, delivered its judgment in which it found Mr. Kofi Annan guilty of defamation against the Member of Parliament for Effutu, Hon. Alexander Afenyo Markin.
The Court subsequently ordered Kofi Annan to retract the defamatory press statement he issued on March 17, 2020 and render an apology to the Plaintiff, Hon. Afenyo Markin, between August 28, 2020 and August 31, 2020.
It also ordered Defendant, Kofi Annan, to publish the apology and retraction using the same media he used for the press conference of March 17, 2020.
Also Defendant was ordered by the Winneba District Court pay an amount of GHC 20,000 as damages awarded against Defendant Kofi Annan with cost of GHC 5,000 bringing the total to an amount of GHC25,000 to be paid to Plaintiff Afenyo Markin.
But aggrieved by the decision of the District Court, the Effutu NDC Candidate, Kofi Annan, has filed a notice of appeal with the High Court challenging the decision of the District Court and also filed a stay of execution against the carrying out of the Orders of the District Court.
However, at its sitting on Friday September 11, 2020, the Winneba District Court dismissed the application for the stay of execution for lack of merit and ordered Defendant Kofi Annan to go and comply with its orders or face the consequences.
He was subsequently slapped with another punitive cost of GHC 2,000.
