The Judicial Committee (JC) of the Ga Traditional Council (GTC) in the Greater Accra Region has declared that one of the claimants to the Ga Dzasetse stool, known as Nii Yartey Oto-Ga is not qualified to be installed as Ga Dzasetse hailing from the Nii Amugi royal ruling house under Ga customary laws.
The man known in private life as Emmanuel Yartey Tackie Yarboi has had an injunction restraining him and his assigns from interfering with functions of the office of the Ga Dzasetse.
The JC’s ruling further restrained him from engaging or performing any role which otherwise is the preserve of the Ga paramount stool Dzase.
The JC ruling restraining Mr Yartey Oto –Ga dated February 8, 2018, was in the matter of Nii Agyemankesse II (plaintiff) versus Nii Yaote Oto-Ga(defender).
The Judicial Committee declared that the proposed nomination, selection and installation of Nii Yaote Oto-Ga as Ga paramount stool Dzasetse is not in accordance with Ga customs and tradition.
The committee earlier on January 31, 2018, ruled and stated that the Judicial Committee had jurisdiction over the suit and dismissed the defender’s preliminary legal objection and ordered that the suit takes its normal course, with a cost of GHS 500,00 awarded against the defendant.
This ruling was in response to an objection raised by the lawyer of the defendant, Bright Akwetey on October 3, 2017, under Article 274 of the 1992 Constitution section 26 of the Chieftaincy Act 759 of 2008 as to the jurisdiction of the Judicial Committee to hear the suit.
