Minister for National Security, Kan Dapaah, the Plaintiff in a ten million defamation suit being heard in Court is praying the court to dismiss a Motion on Notice for an Order to Dismiss Suit, which was filed by Defendant- Oliver Mawuse Barker-Vormawor on 29 November 2023.
The Minister, in an Affidavit in Opposition to Motion on Notice for an Order to Dismiss Suit, dated 8 December, 2023, stated that “It is obvious the Defendant does not have a viable defence to my Suit thus the instant Application. I accordingly pray the Court for judgment in Default of Defence as per my said Application.”
Contrary to Oliver Barker-Vormawor’s Motion, the Minister said the matters which formed the basis of his Claim were not ‘exclusively innate’ to his ‘performance of the functions of State’, and that his duties do not include offering bribes and or threatening people as the former convener of #FixTheCountry movement alleged against the minister personally, which he denies.
On Oliver Barker-Vormawor’s Motion that Kan Dapaah, having at all material times been performing the functions of the State- would not be personally liable for any claims or proceedings in respect of the matters forming the subject of the suit, the Minister contended that “the Defendant’s impugned allegation against me, which were allegations of commission of a crime, were made against me personally and I have suffered a personal loss.”
“That in the discharge of my official duties I do not have immunity from Civil and Criminal Proceedings and by parity of reasoning I am entitled to take steps to restore my reputation and dignity when same are violated unjustifiably and in the instance case,” the counter motion noted.
Recall that Oliver Barker-Vormawor is in court for alleging that the National Security and other government officials met him in 2021 and offered him money to supposedly silence him.
Mr. Barker-Vormawor claimed without a shred of evidence that he was offered an enticing amount of $1 million and other juicy positions in government in order to stop this activism, which was supposedly painting the government black.
Prodded further, the activist insisted that he had evidence to back his claim, but he is yet to make the files public.
