Titanium 123 Properties Limited has filed a motion seeking to have Kofi Abban, Kofi Abban Holdings, and Edward Tetteh a.k.a Akploti, committed to prison for contempt of court following an alleged violation of a ruling by the High Court in a land dispute case.
The company, which is embroiled in a legal battle with Menlix Ventures and other parties over a 22.36-acre parcel of land in Prampram, claims that the respondents deliberately ignored a court ruling issued in July 2024.
The ruling which was granted in part, prohibited both plaintiffs and defendants from further activities on the land but allowed grantees of Titanium 123 Properties to continue with their construction projects.
In the affidavit supporting the motion, Christian Kpakpo Abbosey, a director of Titanium 123 Properties, accused the respondents of taking unlawful actions less than two weeks after the court’s ruling and stopped them from working on the Land.
He claimed that Kofi Abban and Edward Tetteh, acting on behalf of Kofi Abban Holdings, used hired military personnel and police officers to forcibly stop workers employed by Titanium’s grantees from carrying out lawful construction activities on the land, this at that time was aided by the then National Security Minister in August 2024 when all attempts to intimidate and frustrate the company failed.
According to the affidavit, the respondents not only destroyed the work done by the grantees, but they also assaulted some of the workers and further disrupted construction by covering dug-out foundations.
Photographs of the demolished structures and the alleged assault were submitted as evidence to the court.
The applicant argues that this conduct is a blatant disregard for the court’s ruling and a direct challenge to the authority of the judiciary.
Further complicating matters, Titanium 123 Properties claims that the respondents attempted to justify their actions by filing an application on 16 August 2024 to have the court’s order varied which was again refused in February 2025.
However, the motion was filed after the respondents had already violated the court order, according to the affidavit.
The applicant has called for the court to take severe action against the respondents, including committing them to prison for contempt and ordering them to vacate the land.
Additionally, Titanium 123 Properties is seeking compensation for the destroyed properties, which they claim are valued at approximately GH¢200,000.
The motion will be heard in court on a date to be determined, with Titanium 123 Properties requesting that the respondents be held accountable for their flagrant disregard of the court’s authority.
This legal development has drawn attention to the ongoing land disputes in the region and underscores the importance of enforcing judicial decisions in order to maintain order and protect the rights of all parties involved.
In an interview with Directors of Titanium 123 Properties Limited, they indicated that recently one ASP Malaika-Jabril Alhassan who confirmed on phone that he was sent by the National Police Operations Directorate at the National Police Headquarters, has been frustrating them on their land.
You may recall that the same ASP Malaika was recently involved in a case of Contempt of Court case with COP Yohonu (Deputy IGP) as he then was, for some unauthorised demolishing in East Legon.
According to the company, even though there is a Court Ruling that went in their favour, allowing their clients to work pending the final judgement, there are attempts by ASP Malaika and some armed men who are assisting Kofi Abban in unduly taking over their land, sending a signal of top police and political involvement in the whole take-over of the land.
They revealed that “after waiting for over eight (8) months for the final ruling, we have a ruling from the court for our clients to work but all attempts is being made to take the land away from us.”
