The Municipal Chief Executive Officer of the Akuapem South Assembly in the Eastern Region, Frank Aidoo, has hauled two directors of a Real Estate before the Accra High Court for defamation.
They are the Managing Director of Revealed Truth Properties, Gloria Nyarko and Bridgette Ofosu – Sarkodie.
The Plaintiff is demanding Ghc1million from the defendants for damaging his reputation through libelous letters and publications.
Mr. Frank Adioo through his lawyers Kofi Addo and Associates has also sued Revealed Truth Properties as an entity.
The Plaintiff in his statements of claims, cited by DGN, the MCE, is seeking a declaration that a publication and words contained in the Defendants various letters dated 21st December 2020 addressed variously to the Inspector General of Police, the Chief of Staff, the Press, the Eastern Region Minister and also published and carried by some websites are libelous and defamatory.
The MCE of Akuapem South is also seeking general damages against the Defendants for the said libelous and defamatory publications.
Consequently, Plaintiff is seeking special and aggravated damages of Ghc 1,000,000 from the defendants for the damage caused to his reputation.
Mr. Frank Adioo, the Plaintiff is further asking the court to order the Defendants to wholly retracts the said publications and letters and apologize to him through the same medium used by them in labeling him.
In the writ summons filed at the Accra High Court, the Plaintiff additionally is asking for ” An order of perpetual injunction restraining the Defendants from continuing with, or carrying out any such further libelous and defamatory publications against the Plaintiff in any medium whatsoever”.
Background
Miss Gloria Nyarko, the Managing Director of Revealed Truth Properties has petitioned President Akufo-Addo over the alleged continuous bullying and delays of the permit by Frank Aidoo, the Municipal Chief Executive (MCE) of the Akwapem South Municipality.
The land in question is a large tract of land approximately 8.39 acres at Pokrom in the Akuapem South Municipality of the Eastern Region, which the Revealed Truth Properties has stormed on it to use for the construction of residences.
According to them, they acquire it legally, but the MCE is stopping them due to some illegal means they are attempting to use the land without the concerns of the farmers.
The Estate Developer in the petition said “in the course of their work, some thugs (‘land guards’) wielding weapons and claiming to have been sent by the Municipal Chief Executive (‘MCE’), besieged the land. These ‘land guards’ assaulted and drove out our workmen, destroyed equipment and other structures on the land, and further threatened our workmen and our Directors with death should they be found working on the land again,” a statement from the real estate company explained events.
The statement added that a complaint was lodged with the Aburi Police Command against the activities of land guards and the MCE “with the expectation that the Police will intervene, investigate, prosecute the crime and restore peace” to enable RTP to carry on with their lawful business but the police failed to act.
