A ruling by a high court in Tema has convicted F.A Global Estate and other on a disputed land at Apolonia Kubekrom in contention with Setho Engineering Limited.
A copy of the ruling made available to this Paper reveals that on 15th July, 2022, Mr Francis Adu King, F.A. Global Estates Ghana Limited and Nii Adu Ofi ll for and on behalf of the Odaitse We Family were convicted by His Lordship Justice Daniel Mensah for disregarding a court order that prohibits all of them from working on a disputed land at Appolonia Kubekrom.
“The disputed land upon which, FA Global and Adu King are developing are part of the land captured in the substantive case between the HFC, the applicant, which is Setho Engineering and the 1st respondent from whom the 2nd and 3rd respondents take their roots of title,” Justice Mensah observed in his ruling.
It was indicated in the ruling that the order of the court which, binds the 1st respondent goes to affect the 2nd and 3rd respondents as its grantees.
The court therefore convicted them and ordered “each of the respondents to pay a fine of GHC 6,000.00 or in default 30 days imprisonment.”
It was after their conviction that DCOP Daniel Kwame Afriyie, Tema Regional Police Commander and the Land Commission without consulting court judgements, rulings and the pending case awaiting final judgment to declare the convicts owners of the disputed land.
There are claims that the outcome of the court ruling was why residents and other occupants of the land who are being terrorised by land guards employed by the convicts believe that the police are complicit of the impunity unleashed on them.
“The land guards led by one Jabani Sule and Alex indicate that the Tema Regional Commander and Land Commission have allotted the land to Philip and King,” some threatened occupants alleged.
Meanwhile, all efforts made seek the views of the accused persons proves futile.
