Captain Edmond Kojo Koda and two others namely; Eugene Sowah Odamptey and Hares Muda have been cited for contempt of court in their flagrant disregard for the processes of court in their bid to forcefully execute possession of a parcel of land in Adjiriganor when a
motion for stay of execution had already been served on them.
In an affidavit deposed in the name of Nii Afutu Gbomosane II(Ex parte) seeking an order for comital for contempt against the trio under the advice of his lawyers, he clearly stated that after court had granted the respondent’s application for leave to issue writ of possession, he being aggrieved with the ruling of the court filed notice of appeal seeking to set aside the ruling of the court.
And, on the back of the appeal, he proceeded to file an application for stay of execution and same served on respondents through their counsel and it’s therefore bizarre and instructive to note that despite the service of the application for stay of execution, they are still forcibly trying to possess the land through very unconventional mode of operations.
Mr. Gbomosane II stated that the willful conduct of the respondent is not only in bad faith but one that makes mockery of the court and usurps the judicial power of the court as granted under the 1992 Constitution of Ghana.
He further stated that the respondent’s wrongful conduct is tantamount to contempt of court and warrants the imposition of such appropriate punitive sanction to serve as deterrent to others who
may dare to thread the same path as the respondents.
