The Chief Executive Officer (CEO) of Top Kings Enterprise Limited (TKEL) Mr. Kingsley Owusu-Achau has filed an ex-parte motion on notice for committal of contempt against two police officers whom he alleges to have been trying to bend a Supreme Judgment he (Top Kings) won against Empire Builders in favor of the latter.
According the CEO of Top Kings, DCOP Faustina Agyeiwaa Kodua Andoh-Kwofie who is the Director General of the Criminal Investigations Department (CID) and another called Supt. Alhassan Bawa at the Property Fraud Unit at the Headquarters have been frustrating him (Top Kings) at all fronts in his attempt to executive the Supreme Court judgment by way of developing his land after winning judgment in a protracted 22years land litigation with Empire Builders.
He said, the two officers have conducted themselves in a manner that brings the administration of justice into disrepute and hence his application for contempt against the law enforcement officers.
The ingredients of his contempt case is that the two police officers (respondents) have shown disrespect to the judiciary inclusive of the Supreme Court by preventing Top Kings and it’s grantees from developing the land by having police patrol vehicles visiting the land in the company of officials of Empire Builders to cause the arrest of workmen of Top Kings and it’s grantees.
In his affidavit, Top Kings state that in fact these two officers when they (Top Kings) went there to secure bail or release for their workmen and grantees arrested, the two police officers had told Top Kings grantees to ignore the various judgment in favor of Top Kings because the land rather belongs to Empire Builders.
Regardless of the numerous judgments denying and dismissing Empire Builders Ltd which have been brought to the attention of the Respondents, they still that Top Kings and it’s grantees would not be allowed to develop the land until they reach a compromise with Empire Builders.
He further deposed that “I therefore find it strange that after 24years of litigation at the courts initiated by Empire Builders itself which didn’t go in it’s favor, the Respondents herein are bent on giving Empire Builders Ltd, what the Courts have consistently denied it.
In a related development, an attempt by Empire Builders to relist their appeal which was earlier struck out for non-compliance at the Appeals Court was again dismissed by the court ruling thus: “… we think that the conduct of the Application is such that we should not exercise our discretion in their favor. The Application to relist the appeal is refused.
