Nana Essel Amoaqunadoh II, Chief of Fetteh Kakraba has called on residents and individuals who own lands in the area to take steps in regularizing their land documents.
According to him, majority of persons owing lands in his jurisdiction have no proper documentation because they have purchased lands from persons who do not have the authority to sell lands.
His caution came at the back of a Cape Coast High Court ruling which granted an order for possession and execution for the chief of Fetteh Kakraba in the Gomoa East District of the Central Region.
Chief of Fetteh Kakraba, Nana Essel Amoaqunadoh III has been litigating with Gomoa Fetteh Stool with over 5,800 acres of land which complies with over 10 villages.
In 2010, the Chief of Fetteh Kakraba, Nana Essel Amoaqunadoh took Gomoa Fetteh Stool to court Cape Coast Highway Court pleaded with the court to prevent Gomoa Fetteh Stool from encroaching their lan.
Nana Essel Amoaqunadoh argued that, Gomoa Toansah, Gomoa Abekum, Gomoa Nkwatanan, Gomoa Mamfam, Gomoa Ojo, Gomoa Amadua, Abora and others falls under Fetteh Kakraba while Nananom of Gomoa Fetteh also argued that all this villages including Fetteh Kakraba is under Gomoa Fetteh is all the land belongs to Gomoa Fetteh Stool.
On 11th June 2014, Cape Coast High Court ruled in favor of Chief of Fetteh Kakraba Chief Nana Essel Amoaqunadoh (iii) but before the ruling the Land has been already sold by a group of Land Guards.
Nana Essel Amoaqunadoh iii said , in 2016 they filed for write of Possession and the court granted for them but still the alleged land Guards were terrorizing them from taking back their land.
On 5th July 2024 Counsel for Plaintiff Roland A. K Hamilton Esq pleaded with the same Cape Coast court to give them a recovery order so that his client can negotiate with the occupants and resold them land to them since they have already built on the lan.
On 17 th July 2024, The Cape Coast High Court ordered that, the Plaintiff which is Nana Essel Amoaqunadoh should use only lawful and permissible means of esserting their right from enjoying the fruit of the judgement and also enforce the said judgement as granted in their favor.
The IT IS AGAIN ORDERED THAT leave is granted to the Plaintiff/ judgement / creditors to seek a police or military assistance in the enforcement of this order.let it be known that the Security Agencies must not use illegitimate or any unwanted force in the performance of their duty as they must protect lives and properties.
It is against this backdrop that the chief has cautioned all including prospective land buyers to do well by contacting the rightful owners of the land.
