The Numo Kofi Anum (Tesa) Family has strongly refuted recent claims by real estate developer Regimanuel Gray Limited, describing the company’s publication on their land dispute as “false, misleading, and legally untenable.”
In a rejoinder issued on Thursday, the family said Regimanuel’s assertion that a stay of execution had nullified their judgment rights over the disputed land was a deliberate misrepresentation.
According to the family, the Supreme Court of Ghana has already affirmed them as the lawful allodial owners of more than 918 acres of land, including 123 acres currently being occupied by Regimanuel Gray.
The High Court, relying on the Supreme Court ruling and a composite plan, also confirmed that the area developed by the company falls within the Tesa Family’s land.
Judgment Already Executed
The family emphasized that the judgment in their favour has already been executed, with portions of the land taken over through lawful enforcement by court bailiffs.
“Any purported stay of execution granted after enforcement cannot apply retroactively,” the statement noted, adding that a search at the High Court Registry confirmed execution was levied before Regimanuel’s stay application was considered.
Regimanuel’s Titles Declared Invalid
The family also pointed out that the courts had ruled against land titles GA 12369 and GA 18289, relied upon by Regimanuel, because they were issued by the Nungua Stool which had already lost ownership of the land.
“Only the Tesa Family can grant valid title,” the rejoinder stressed.
Stay of Execution Was a Grace Period
The rejoinder clarified that the 12-month stay of execution granted earlier was not a relief from liability but a grace period to allow Regimanuel to negotiate in good faith and make payment, valued by the Lands Commission at about GHS 18 million.
However, the family said the company “failed or refused” to engage in any meaningful discussions, forcing them to apply for and obtain a writ of possession, which was duly executed.
Ongoing Litigation
While acknowledging pending appeals, the family noted that none of them challenge the Supreme Court’s declaration of their allodial ownership.
They also accused Regimanuel of abusing the legal process and resorting to “misinformation and propaganda” instead of engaging lawfully.
Family’s Position
The Tesa Family reaffirmed that:
They remain the undisputed owners of the 918 acres of land;
The Supreme Court judgment in their favour is still binding and has not been overturned;
They are no longer interested in settlement negotiations with Regimanuel;
They will pursue all lawful means to fully enjoy the fruits of their judgment.
The family concluded by advising the public to disregard Regimanuel Gray Limited’s claims and pledged to continue defending their legally established rights.
